In the context of Integrated Coastal Zone Management in border regions, legal, administrative and spatial aspects play an important role. In the German-Polish Oder estuary region the complex set of legal rules, administrative structures and planning instruments was investigated under the particular conditions of a border region. This analysis of legal and administrative structures occured on the basis of Chapter III of the EU Recommendation 2002/413/EC of the European Parliament and of the Council of 30 May 2002 concerning the implementation of Integrated Coastal Zone Management in Europe. Against the background of this investigation, the characteristics of German and Polish legal and administrative structures have been identified. While Poland is characterised by a central structure, Germany has a federal structure, with differing planning responsibilities, what may complicate Coastal Zone Management in the region. Without integration into the particular German or Polish spatial planning system, which both show similarities and differences by comparison, Coastal Zone Management cannot be implemented successful in the Oder estuary region. A reliable basis for cooperation in coastal zone issues is offered by the European Grouping of Territorial Cooperation (EGTC) as a coordination instrument with a legal personality (Art. 1 para 1 Regulation (EC) No 1082/2006). Main tasks of this grouping are facilitation and strengthening of territorial cooperation to improve economic, social and territorial cohesion. This includes particularly the implementation of territorial cooperation programmes or projects cofinanced by the Community, notably under the Structural Funds in conformity with Regulation (EC) No 1083/2006 and Regulation (EC) No 1080/2006 or other particular actions of territorial cooperation on sole initiative of the Member States and their regional and local authorities, with or without a financial contribution from the Community. Both areas of responsibilities can be applied in the Oder estuary region.
